These Terms of Service ("Terms") govern your use of the Baraja macOS application ("the App") and the website swirlsoft.co ("the Site"), published by Swirl Software ("we", "us", "our").
By downloading, installing, or using the App, or by purchasing a license, you agree to these Terms. If you don't agree, don't use the App.
When you purchase Baraja, we grant you a non-exclusive, non-transferable license to install and use the App on Mac computers that you own or control, for personal or professional use.

The App Store version is distributed under Apple's standard End User License Agreement.
A direct-download license covers the current major version (v1.x) and all v1.x updates. Future major versions (v2.0+) may require a separate purchase at a discounted upgrade price.
Baraja requires API keys from Google (Gemini) and OpenAI. Your use of those services is governed by their respective terms of service. You are solely responsible for your API usage and any associated costs. We are not responsible for changes to third-party APIs or terms.
You own all content you generate with the App. We make no claim on your flashcard decks, audio files, or any other output. You are responsible for ensuring your use of the App complies with the terms of any AI APIs you use.
We may release updates to fix bugs or add features. We are not obligated to provide updates, but we intend to maintain the App for the life of the v1.x product line.
If Baraja does not work on your Mac after purchase, contact support@baraja.ai within 14 days and we will issue a full refund. Refunds for purchases made through the Mac App Store are handled by Apple.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FIT FOR ANY PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIRL SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP.
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
We may update these Terms from time to time. We will notify you by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.
